privacy, including the privacy of your information, pictures and custom
movies. This Privacy Policy provides information regarding the
information we collect through our website at www.togetherwithyou.com
(the “Site”) and our other services, and how we use this information
when providing service to you.
By accessing and using the
Site or other Together With You services (collectively, the
“Services”), you agree to the terms and conditions of this Privacy
Policy. Please do not use the Services if you do not agree to the terms
and conditions of this Privacy Policy.

Policy was last updated on May 14, 2009. Together With You reserves the
right to modify this Privacy Policy at any time. If this Privacy Policy
changes, the revised policy will be posted on the Site, and we will
change the ‘Last Updated’ date at the top of this page to reflect the
date that the policy was updated. Please check this Privacy Policy
periodically, as any changes to our Privacy Policy will become
effective upon our posting of the revised Privacy Policy on the
Services and use of the Services following such changes constitutes
your acceptance of the revised Privacy Policy then in effect.
I. Collection of Information through Together With You’s Services
Together
With You gathers two types of information through the Services: (a)
“Personal Information” and (b) “Non-Personal Information.” “Personal
Information” is personally identifiable information that identifies you
as an individual. “Non-Personal Information" is non-personally
identifiable information, which includes any other information that
does not reveal your specific identity.
- Personal Information.
Although you are not required to provide Personal Information to use
the Site, you may need to provide certain Personal Information to use
some of Together With You’s other Services. When you sign up with
Together With You, you must establish a password-protected personal
account for storing and organizing your digital images, creating your
custom movie, and for using the other Services. We will need your name,
email address and password in order to establish your Together With You
account. When you order your custom movie or other paid products or
services, we will need the shipping address, billing name and address,
and the credit card number and expiration date.
- Non-Personal Information.
We and our service providers and business partners may collect
Non-Personal Information when you visit and interact with the Services.
This Non-Personal Information may be collected from a variety of
sources, such as server log files, environmental variables, and from
navigational data. We collect and analyze this Non-Personal Information
about our users in order to help us deliver better service and user
experience. This Non-Personal Information could include websites you
may have visited before visiting the Site, IP addresses, or areas of
websites being clicked on most frequently. We and our service providers
(including, but not limited to, ad servers, affiliate vendors and
search engine advertising agencies, and providers of web analytics
tools) and business partners may also use “cookies,” “pixel tags,” and
other similar technologies to help us deliver better service and user
experience. If you do not want information collected through the use of

- Personal Information. Together With You may use Personal Information in the following ways:

Together With You may use your Personal Information to fulfill the
purpose for which such Personal Information was provided. For example,
we may use your personal information to fulfill your purchase or other
transaction.
- Service Announcements.
Together With You may periodically send you service announcement with
important information about Together With You. Service announcements
may contain information about to your account, so you cannot
unsubscribe from service announcements.
- Promotion Communications.
Together With You may notify you via email or mail about new features,
services, products and promotions. We may also send you information on
screened third parties whose products or services may be of interest to
you. If you would like to unsubscribe from these mailings, please
review the instructions in the Section VI ("Opt-Out") below.
- Contests and Surveys.
Together With You may request your Personal Information through surveys
or contests. Your participation in these surveys or contests is
voluntary. The Personal Information collected through these surveys and
contests is only used for purposes of improving user satisfaction with
Together With You products and services and to notify winners and
deliver prizes.
- Testimonials.
Testimonials demonstrate the benefits of Together With You’s products
and services. Together With You always seeks consent prior to posting
any testimonial in which Personal Information is included.
- Customer Service.
Your communications with Together With You’s Customer Service team may
be recorded to help us provide better service. Your Personal
Information may be obtained and used in this manner.
- Internal Business. Together With You may use your Personal Information for internal business purposes (e.g., data analysis, audit, etc.).
- Combination of Information.
Together With You may combine your Personal Information with other
information you have shared with us to in order to customize our
Service to you and improve your experience with our products and
services. Based upon your past preferences, we may recommend products,
services or offers in which you may be interested. We may also remind
you that you have an active shopping cart with Together With You. In
addition, Together With You may supplement the Personal Information you
submitted to us with information from third party sources n order to
provide certain services to you. For example, Together With You may use
the U.S. Postal Service’s national change of address database to verify
your mailing address.
- Non-Personal Information.
Together With You may use your Non-Personal Information for any purpose
because this information does not personally identify you. We also
reserve the right to share your Non-Personal Information with third
parties for any purpose. We may combine your Non-Personal Information
with Personal Information. However, if we combine any of your
Non-Personal Information with your Personal Information, the combined
information will be treated by us as your Personal Information as long
as it is combined.
III. Personal Information Disclosures
- Third Party Service Providers.
Together With You shares your Personal Information with carefully
screened third-party service providers to provide you with the
products, services and information you have requested. For example, we
may share your Personal Information with credit card authorization
companies, merchandise distributors and shippers.
- Third Party Products and Services.
Together With You may share your Personal Information with third
parties in order to allow these third parties to provide you with the
products, services and information you have requested (e.g., packages
of discounts, rebates, and promotional offers other than Together With
You products, services or information). Third parties from whom you
have requested products, services and information will handle, store,
retain, use, share and access your Personal Information in accordance
with the terms and conditions of their agreement(s) with you, as well
as their own privacy policies. They may also use your Personal
Information for direct marketing purposes. You are responsible for
reviewing such terms and conditions and privacy policies, and Together
With You disclaims any and all liability relating thereto.
- Third Party Communications.
Together With You may share your Personal Information with third
parties for such third parties’ direct marketing purposes. These third
parties to whom we transfer your Personal Information for direct
marketing purposes will handle, store, retain, use, share and access
your Personal Information in accordance with their own privacy
policies. You are responsible for reviewing such terms and conditions
and privacy policies, and Together With You disclaims any and all
liability relating thereto. If you would prefer that Together With You
does not share your Personal Information with third parties for their
direct marketing purposes, you may submit an opt-out request as
described in Section VI (“Opt-Out”) below.
- User Forums.
Together With You may make available forums to which you are able to
post information and materials. Please note that any information you
disclose through such forums becomes public information, and may be
available to users of the Services and to the general public.
Furthermore, when you make a posting on such forums, some of your
Personal Information will be available for other users to view. Please
exercise discretion and caution when deciding to disclose your Personal
Information or any other information through the Services. TOGETHER
WITH YOU IS NOT RESPONSIBLE FOR THE USE OF ANY PERSONAL INFORMATION YOU
VOLUNTARILY DISCLOSE THROUGH THE SERVICES.
- Law Enforcement, Emergencies and Compliance. Together
With You may disclose your Personal Information in the following
situations, even though you may have requested that we do not share
your information: (a) under applicable law; (b) to comply with legal
process; (c) to respond to governmental requests, including but not
limited to, requests from law enforcement and regulatory authorities;
(d) to enforce our terms and conditions; (e) to protect our operations;
(f) to protect the rights, privacy, safety or property of Together With
You, you or others; and (g) to permit us to pursue available remedies
or limit the damages that we may sustain. The decision to use your
Personal Information in these circumstances shall be made in Together
With You’s sole discretion.
- Assignment.
Together With You may transfer your Personal Information to a new
entity or third party as part of a merger, acquisition, reorganization,
sale of assets, joint venture, assignment, transfer or other
disposition of any portion of business, assets or stock (including,
without limitation, in connection with any bankruptcy or similar
proceedings). Together With You will notify you via email and/or
prominent notice on the Site if the third party’s or new entity’s
treatment of your Personal Information will materially differ from that
set forth in this Privacy Policy. Said notice will be provided at least
thirty (30) days before such material changes take effect.
IV. Protection of Your Pictures
Together
With You gives you the ability to control who views the pictures and
other information stored in your Together With You account. It is our
goal that your pictures are not publicly accessible, except by your
explicit action, or as otherwise noted in this Privacy Policy. However,
if you share your pictures with your friends or family members and they
post your pictures on a website or forward your pictures other
individuals, your pictures may be accessible to others who visit these
websites or receive the pictures. We have no control over, and are not
responsible or liable for, the privacy of any pictures that you have
shared with others.
In order to provide the best quality
products and services, the Together With You employees and third-party
service providers may see your pictures.
Please note that
Together With You holds pictures for at least two (2) weeks after you
delete them. Thereafter, Together With You removes your pictures from
its server.
V. Updating Personal Information
Together
With You will try to keep all of your Personal Information updated when
you provide updated information to us. You may update your account
information and change your password at any time. If you forgot your
password, you may set a new password by contacting our Customer Service
team at service@togetherwithyou.com.
If any of your Personal Information changes or you notice a mistake in
our records, please use the account profile page on the Site or contact
us using the link in Section XI (“Contact Us”). We will update your
data as soon as is reasonably practicable.
VI. Opt-Out
If
you would like to unsubscribe to Together With You’s notification
services, you may do so through your account profile on the Site. Just
go to your “My Together With You” page and click on “Personal
Info/Settings,” then on “Email Preferences” or contact our Customer
Service team. Together With You may periodically share your Personal
Information with affiliates or third parties in order to allow them to
contact you regarding products, services and promotions that may be of
interest to you. If you do not want us to share your Personal
Information with affiliates and/or third parties for their direct
marketing purposes, you may submit an opt-out request by going to your
“My Together With Yo” page and selecting the “Personal Info/Settings”
link and then clicking on “Email Preferences.” Together With You will
comply with your request as soon as reasonably practicable. We will not
be able to remove your Personal Information from the databases of
affiliates or third parties with which we have already shared your
Personal Information as of the date that we implement your opt-out
request. If you wish to stop receiving marketing emails from any of
these affiliates or third parties, you will need to contact the
affiliate or third party directly or use any opt-out mechanisms
provided in their marketing emails or privacy policy.
VII. Security
Together
With You tries to implement reasonable security measures in order to
protect against the loss, misuse and alteration of the information in
our possession. However, no data transmission over the Internet or data
storage system is 100% secure. Therefore, we cannot ensure or warrant
the security of any information you transmit to us through or in
connection with the Services or that is stored by us. You acknowledge
and agree that any information you transmit through the Services or
upload for storage in connection with the Services is transmitted or
stored at your own risk. If you have reason to believe that your
interaction with Together With You is no longer secure, you must
immediately notify us of the problem by contacting us in accordance
with Section X (“Contact Us”) below. Please note that our response to
the problem will be delayed if you choose to notify us via physical
mail.
VII. Protecting Children’s Privacy
Together
With You’s Services are not intended for use by children under the age
of 18. Together With You’s Services are not directed at such children.
We do not knowingly collect Personal Information from children under
the age of 18. Please do not register at Together With You if you are
under the age of 18.
IX. Third Party Sites
The
Services may contain links to third party websites, which are not under
our control. Therefore, we are not responsible for the privacy
practices or the contents of these linked sites or any links contained
in any linked sites. These links are provided only as a convenience to
you. The inclusion of a link on the Site does not imply endorsement of
the linked site by Together With You. If you provide any Personal
Information through any linked third party website, your transaction
will occur on such third party's website (not the Services or the
Site), and the Personal Information you provide will be collected by,
and controlled by the privacy policy of, that third party. THIS PRIVACY
POLICY DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY
THIRD PARTIES.

Services are controlled and operated by Together With You from the
United States, and the Services are not intended to subject Together
With You to the laws or jurisdiction of any state, country or territory

does not represent or warrant that any of its products or services are
appropriate or available for use in any particular jurisdiction. People
who choose to access the Services do so at their own risk and are
responsible for complying with all applicable local laws, rules and
regulations. Together With You may limit the Services’ availability to
any person, geographic area or jurisdiction we choose. Said limitation
may occur at any time and in our sole discretion.
The state
and federal courts of Arkansas are the exclusive forum and venue to
resolve any and all disputes arising out of or otherwise relating to
this Privacy Policy. You hereby consent to personal jurisdiction and
venue by the state and federal courts of Arkansas.
